Fluidbloc offering no resistance at all?

Just found out a few things while working on the handlebars setup this week end.

1- My bike has the Fluidbloc
Damper

2- It obviously doesn't offer any resistance at all

Are they known to fail? It's a very simple design as far as it goes. The two screws are definitely gripping it so it's not spinning freely in the steering tube.

Also the heabearings seem a little loose, but I can't get the adjuster nut to budge.

Any tips? There's not much room to work on it, except by removing the tank, which I'd LOVE to avoid.
