That is downright scary.

OTH, around here we have a lot of deer crossing signs and moose crossing signs that are usually in different areas. Wouldn't it be easier if they had the deer and the moose crossing in the same places?  :hehehe

I find it hard to believe as well.  She had to be kidding or set up!  No one is that stupid (I hope).

I agree with her. The deer lobby is too strong and has too much influence over the DOT.
Once I had a Collie pup. Dug a hole and covered him up. Now I sit there by the hour. Waiting for a Collie-flower.

LOL Some people just don't have a clue. I wonder if she is the type that would turn left in front of a biker.

Here is a letter that my wife sent to the insurance co. last week.

October 9, 2012

Att:  *******, Claims Manager

RE:   Insured   :      ******
   Policy Number:   *******
   Claim Number   :   ********
   Date of Loss:      9-28-2012

Dear Ms. *****

I have received the letter of determination (of fault) regarding my accident on 9-28-12.  An accident that I call:
“Deer vs. Mini”.
The final score:  Deer 1 and Mini 0

The determination letter finds me 51% at fault, stating that “a person shall not drive a vehicle upon a roadway at a speed greater than is reasonable or prudent having due regard for visibility, traffic, and potential hazards on the highway.”

No one even asked me how fast I was going, so how can they determine I was going at an unreasonable speed.  For the record, ****** Road is quite narrow and somewhat winding and I was going fairly slowly, a modest rate of speed.  The deer, on the other hand, (and we’ll call him/her, “Bambi’s Mom”) was not traveling at a reasonable, prudent speed – she was fast, reckless and did not stop at the roadside to “look both ways” before crossing.

I did not think it would be a good idea to crash into the deer, so I chose to swerve to the right and wound up scraping my fender on a fence post.  I think that was a better idea than having a deer crash through my windshield, certainly causing me injury.  That would suck and be very expensive.

Please reconsider this determination of fault and find that Bambi’s Mom, and not me, was to blame, or she was at least 51% responsible.

Thanks very much

Wonder what % they would have come up with if she had hit the deer.

Put yourself in the shoes of the claims manager.   Can you imagine all of the BS explanations they hear for single car accidents?  Without physical evidence (blood, hair, etc...) or a witness there is nothing to substantiate your wife's account.

Not accusing your wife of lying.  Just putting things into perspective for you.

LEO's have the same issue when determining fault in accidents as well.
You swerve to miss a deer, and do miss it but end up in the ditch, YOU get the ticket for failure to maintain control. Witnesses or not.
Gives your insurance co an out at well-----you are considered at fault.
In your car or on your bike, doesn't matter why.
Your only hope of winning that fight would be have a camera rolling all the time and have a view out the window that also see's your speedo so they can't say you were speeding. We all know that this isn't practical, so........

Unfortunately that's the part of the rules they play by in their sandbox.

She thought she would send a letter.
We had nothing to lose.
Did $3,100 of damage to car.
We have a low deductable.
Things could have been worse.
Should get the car back next week.
