I was thinking don't ride on the nascar tracks........ :hehehe
But seriously, you aren't touching the shift lever on accident with your boot?
-
REALLY ? ??

I read a post here recently about someone who thought they found the neutral detente ball in the drain pan after changing gear oil. I'm not sure what that ball does but if it does what it sounds like it does, then it might have something to do with it.
Maybe you could put it on the sidestand and try to recreate it.

Sounds like an interesting problem. I really doubt that the shift lever is hitting the ground. If you placed a stick with one end between the tires and angled it up until it hit the lever, I think the stick would be more upright. Of course you have to account for the suspension being loaded up.
Also there would be scratch marks on the lever.
Has the bike been dropped on its left side? Seems like M/C shift internals can be damaged when the bike is dropped on the shift lever. Is the trans oil level correct?

bought donar bike in pieces,it was totaled from a fall over but on rt side . left panels were all ok shifter is unmarked , level is perfect no leaks, boot almost never touches ground and boot is not touching shifter, when it happens I pull up on shifter and its in 3rd , I do not feel any other issues , this trans 45k original was 110k ,definitely shifts better than original
